Ordinance 539: Amending Land Development Code - Play Structures

 

Summary: This draft ordinance produces language surrounding the construction and installation of play structures within residential zoning districts. It defines portable accessory structures, outlines limits per zoned lot, as well as location requirements.

Background/Problem Discussion: Staff sought input on potential amendments to the Town Code of Ordinances to clarify regulations on the placement and permitting of residential play structures including swing sets, playsets, playhouses, and treehouses. The code is currently silent on the specific issue of these play structures. The Building Official and staff currently utilize the broad language of Article 4, Section 2 of the Land Development Code relating to temporary structures as well as the Florida Building Code to regulate these structures.

 

With approval of this ordinance, these structures will be regulated upon zoning district, location on the property, height, and square footage.

 

Expenditure Challenges: None.

 

Previous Action: On September 13, 2021, the Planning and Zoning Board recommended this ordinance for approval.

 

Recommendation:  Staff recommends approval of the ordinance as proposed.
