Second Reading of Ordinance 521 - Special Relief Permits
Summary:
Ordinance 521 establishes the process for commission action to temporarily provide relief from code regulations relating to special events or rare circumstances. As drafted the Commission could waive elements of the following ordinances:
1) Section 6-2: Drinking in Public; possession of open container
2) Article II: Parking
3) Article III: Commercial Solicitation
4) Section 74-311: Home Occupations
5) Section 74-484: Public Nuisance Noises
6) Section 74-572: Permitted temporary signs
The Commission would consider the event in totality and may attach conditions for its approval to ensure the health, safety, comfort, convenience, and welfare of the town and its residents. Applicants would be charged a permit fee to make the appeal. Each application would need to be received by the Town Manager at least three weeks in advance of the proposed event and would require specific details about the event for the Commission to make its decision. This process would apply to residents, organization and the town anytime it wanted to hold an event which would need relief from any of the above sections.
