Title: Resolution 2019-28: Pertaining to the sale of the former Ahlf Properties Summary: Due to the holiday week, final versions of the attachments will be available and updated on 12/02/2019 The attached resolution seeks enact the manner in which the Commission will dispose of the 3 parcels of land on Baybrook, formerly known as the Ahlf properties. The primary intent is to lay out the competitive sales procedures, and selection of successful buyers. In sum, offerors will be blind to the commission during the 60 day offering period and during the ranking process of the best offers. Any potential offer outside of this process or in violation of the confidentiality rules should be disqualified and not considered. The form of the contract to be used for sale is included as an attachment as well. Upon successful negotiation of a contract an ordinance approving the sale will be drafted and closing will occur after final reading and adoption.

Previous Commission Action: The Commission previously found the properties to be surplus and approved the engagement with CBRE for brokerage services.

Background/Problem Discussion: In accordance with Article VIII, section 2 (b), Florida Constitution, and Chapter 166 Florida Statutes, the Municipal Home Rule Powers Act, that in the absence of a town charter provision, ordinance or rule to the contrary, the town commission may, in its discretion, utilize whatever method or procedure it decides will be in the best interest of the municipality in disposing of surplus municipal real property. Approval of this ordinance will conform to this guidance.
